The Retirement Advantage, Inc. (“TRA,” “we”, “our,” or “us”) recognizes that the privacy of your personal information is important. The purpose of this privacy policy (“Policy”) is to let you know how we handle information collected through the use of www.tra401k. com and https://markleyactuarial.com (the “Websites”), our TRA mobile application (the “App”), and any other website or application that links to, references, or displays this Policy, as well as how we handle information you otherwise provide us or we obtain as described in this Policy (collectively, the “Services”). Portions of this Policy may describe privacy practices applicable to specific types of information, or to information provided on specific Services.

Any information you provide, including any personal information, will be transferred to and processed by a computer server located within the United States.

Email
Sending emails over the Internet may not be secure. Please consider this fact before emailing any personal or confidential information to us. TRA always recommends using a secure email service to send or receive emails that may contain personally identifiable information (“PII”) or protected health information (“PHI”).

Cookies and Tracking
TRA uses various technologies, which may include “cookie” technology, to gather information from our Services visitors, such as the pages visited and how often, and to enable certain features on the Services. “Cookies” are small text files that may be placed on your computer when you visit a website or click on a URL. Cookies may include “single-session cookies”, which generally record information during only a single browser session and then are erased, and “persistent” cookies which are generally stored on a computer unless or until they are deleted or expire. You may disable cookies by adjusting your browser preferences at any time; however, this may limit your ability to take advantage of all features on the Services.
“Web beacons” or “tracking pixels” are electronic images, tags, or scripts that allow a website to access cookies and among other things, help track general usage patterns of visitors to a website. We and the third parties described below may use web beacons to compile information regarding your use of the Services.

If you are using the App, or interacting with the Services on a mobile device, additional information may be collected, including your mobile device’s unique device ID and information about how you use the Services.
We may use analytics companies, such as Google Analytics, to gather information and aggregate data from our Services visitors such as which pages are visited, and how often they are visited, and to enable certain features on the Services. Information is captured using various technologies and may include cookies.

We may use and disclose your activity information unless restricted by this Policy or by law. Some examples of the ways we use your activity information include:

  • Customizing your experience on the Services including managing and recording your preferences;
  • Marketing, product development, and research purposes;
  • Tracking resources and data accessed on the Services;
  • Developing reports regarding Services usage, activity, and statistics;
  • Assisting users experiencing Services problems;
  • Enabling certain functions and tools on the Services; and
  • Tracking the path of visitors to the Services and within the Services.

Your Personal Information
The Services include web pages that give you the opportunity to provide us with personal information about yourself such as name, billing address, email, social security number, date of birth, credit card information, financial information, date of hire, employer name, company assets, eligible employees, plan identification number, and phone number. You do not have to provide us with personal information if you do not want to; however, that may limit your ability to use certain functions of the Services or to request certain services or information.
TRA may use personal information for a number of purposes such as to:

  • Respond to an email or particular request from you;
  • Process a distribution or loan as requested by you;
  • Retirement plan compliance related tasks standardly provided by a third party administrator;
  • Administer surveys and promotions;
  • Provide you with information that we believe may be useful to you, such as information about products or services provided by us or other businesses;
  • Perform analytics and to improve our products, Services and advertising;
  • Comply with applicable laws, regulations, and legal process;
  • Protect someone’s health, safety, or welfare;
  • Protect our rights, the rights of affiliates or related third parties, or take appropriate legal action, such as to enforce our Terms of Use;
  •  Keep a record of our transactions and communications; and
  • Conduct our business, as otherwise necessary or useful, for us so long as such use is permitted by law.

We may use personal information to contact you through any contact information you provide through the Services, including any email address, telephone number, cell phone number, or fax number. Please see the section below titled, “Our Online Communications Practices”.

We may also share personal information within TRA. We may combine personal information that you provide us through the Services with other information we have received from you, whether online, offline, or from other sources such as from our vendors.

Additionally, if you apply for a job online at TRA, you may be asked to provide additional personal information such as your education level, previous jobs, resume, and references. This information will be used by TRA to evaluate you for employment positions only.

Sharing Personal Information
TRA does not sell or rent personal information of users to third parties for promotional or marketing purposes and does not share personal information with anyone outside of TRA for their own promotional or marketing use without user consent. TRA uses personal or financial information to provide users with information and services requested to give a customized, interactive experience with its products. TRA may communicate with users regarding other service or product offerings provided by TRA and may provide notice to users of third-party offerings that may be of interest.

We may share personal information during a transaction involving a sale of all or a part of TRA’s assets, a merger, dissolution, or acquisition of TRA, or in a similar transaction.

We may share personal information in response to a court order, subpoena, search warrant, law, or regulation. We may cooperate with law enforcement authorities in investigating and prosecuting activities that are illegal, violate our rules, or may be harmful to other visitors.

Reviewing and Changing User Information
Users may be able to update certain personal information through various web portals accessible via the Websites. To do so, users may log into the applicable portal(s) by browsing www.tra401k.com and clicking on the Login link and choosing the appropriate option.

Services and Information Security
TRA maintains reasonable safeguards designed to protect the information you provide on the Services. However, no security system is impenetrable and we cannot guarantee the security of the Services, nor can we guarantee that the information you supply will not be intercepted while being transmitted to us over the Internet, and we are not liable for the illegal acts of third parties.

Our Online Communication Practices
TRA (or its service providers on TRA’s behalf) may send electronic newsletters, notifications, or account status and other communications, such as marketing communications, on a periodic basis to various individuals and organizations. We may also send email communications regarding topics related to retirement plans and retirement planning. You may opt-out as provided for in a specific email communication or contact us as described below in the section “Contact Us.” Please be aware that opt-outs may not apply to certain types of communications, such as account status, Service updates, or other forms of communication.

Linked Sites
The Services have links to various other websites, such as social media and news sites, that we think might be useful or of interest to you. TRA, however, cannot be responsible for and does not endorse the privacy practices or the content of its linked websites. We urge you to review the privacy policies of any website you visit once you have left the Services. Links to various non-TRA websites do not constitute or imply endorsements by TRA of these websites, any products or services described on these sites, or of any other material contained in them.

Do Not Track
The Websites does not respond to “do not track” requests. All traffic is treated as equal and processed the same. If you desire to have your browsing be private, we suggest that you use your web browser’s private or incognito function, or similar options.

Children Under the Age of 13
The Services are not intended for anyone under the age of 13, and we do not knowingly collect personal information from children under 13. In the event that we learn that we have collected personal information from a child under the age of 13, without parental consent, we will delete that information and otherwise comply with the requirements of any applicable law including the Children’s Online Privacy Protection Act.
